摘要
在现代刑事诉讼中,不起诉制度作为非刑罚化的一种处理方式,是公诉机关即检察机关发挥起诉程序政策功能的重要途径。尽管我国在1996年修改《刑事诉讼法》时确立了不起诉制度,但是为了防止不起诉制度被滥用,我国《刑事诉讼法》及其司法解释对不起诉制度进行了比较严格的限制,2012年《刑事诉讼法》修改时又对不起诉制度进行了完善。同发达国家相比,我国腐败犯罪案件的不起诉率明显偏低。为了合理配置司法资源,提高司法效率,贯彻宽严相济的刑事司法政策,确保检察机关能够集中精力打击比较严重的腐败犯罪,从根本上解决不起诉适用率偏低的问题,我国亟待扩大不起诉制度在腐败案件中的运用。
It is one of noncriminal penahy that the prosecutor has the discretion to decide whether prosecute or not in modern criminal procedure. The prosecution discretion was established when the Criminal Procedure Law was modified in 1996. However, it was under strict restraint in order to prevent abusing according to the Law of Criminal Procedure and its judicial interpretation. With the Criminal Procedure Law modified again in 2012, the system on the prosecution discretion was perfected in a certain extent. Compared with the developed country, prosecution discretion was limited stricter in China. In the new era, how to encourage the prosecution discretion in the corruption crime is an urgent problem to solve for increasing the efficiency of dealing with corruption and complying with the policy of tempering justice with mercy.
