劳动合同法中违约责任与其他法律责任关系的研究

Study of the Relationships among Liability for Breach of Labor Contract and Other Legal Liabilities

劳动基准法律制度的存在决定了劳动合同法中的法律责任有其独特的适用规则,同时劳动法律行为的多样性、复杂性,又导致了各种法律责任在适用关系上的困惑、纠结、混淆、冲突,为了保证劳动合同的顺利履行,有必要对其予以厘清。文章综合运用劳动法学、民法学、行政法学及刑法学的基本原理,分析劳动违约责任与劳动侵权损害赔偿责任及违反劳动合同的行政责任和刑事责任的适用关系,旨在通过合理的法律责任适用关系的明晰,能够以国家公权力的介入平衡用人单位与劳动者之间的不对等地位,从而能及时有效地补救用人单位与劳动者的合法权益。

Labor standard legal system determines the unique applicable rules of legal liabilities in labor contact.Meanwhile,the multiformity and complexity of labor law behaviors can also lead to the confusion,entanglement,and conflict in the application of various legal liabilities.To guarantee the successful implementation of the labor contact,it is necessary to elucidate these issues.The fundamental principles of science of labor law,science of civil law,administrative law and criminal law are coupled together to disclose the application relationships among liability for breach of labor contracts,the labor contract tort liability for damages,administrative liability and criminal liability for breach of labor contracts,which are focused on obtaining reasonable legal liability application relationship to balance the unequal status of employers and employee via intervening with public power,and achieve the timely and effective remedy of legitimate interest of laborers,as well as those of employers together.
