摘要
教师参与现代大学治理是高校教师的法定权利,这一法定权利的享有与行使是关涉我国现代大学制度建设成败的重大问题。问题是,无论在理论上还是实践中,"教师参与"的内涵与外延上都存在原则性纷争。"教授治校论"者认为高校教师在学校管理中处于主导地位,管理权的范围应该涉及全校事务;"教授治学论"者则主张将高校教师的管理权仅局限于学术领域,其他事务不予干涉。笔者以为,当前我国大学内部管理中最严重的问题表现为权力配置失衡,学术权力缺乏实质性的话语权,改革的关键在于重塑现代大学理念,确立教师在学校管理与决策中的权威地位,构建以学术权力为主导的治理结构,实行学术自由、民主管理、教授治校。这应是我国现代大学制度建设应持有的价值取向。
It is university teachers'legal rights to participate in modern university governance,which is of vital importance to the construction of university system.However,there are many disputes over the connotation and extension of"teacher participation"both in practice and in theory."Professor Governance Theory"holds that teachers play a leading role in university governance and that their administrative power should extend to the whole matters;"Professor Research Theory"thinks that teachers'power should be limited to academic sector only.Currently,serious problems such as imbalance of power distribution and academic power's lack of real voice exist in Chinese universities'internal governance,therefore the author believes university reform should focus on remodeling modern university theory,establishing teachers'authority in governance and decision making.Only by doing so,can a governing structure dominated by academic power be constructed in which academic freedom,democratic management as well as professor governance are achieved,which is also the values should be favored by Chinese university system building.
