摘要
教育惩戒权是教师为维护学校教育教学活动正常秩序,保障教育教学活动正常开展,针对违反学生行为规范、破坏学校纪律的学生行使的管理权,是教师依法管理学生的专业职权。惩戒权的行使,是建设现代学校制度的客观要求,是教师履行法定职责的必要手段。管理学生需要惩戒但应规范。惩戒权的肆意行使必须限制,惩戒权行使的方式必须规制,使惩戒权的行使制度化、规范化。
Disciplinary power in education , a kind of professional power , is executed by teachers to safeguard school order , ensure normal progress of teaching , and punish students w ho violate code of conduct or break school discipline . It is the objective requirement of establishing modern school system and the indispensable approach of fulfilling teachers＇ legal duty . Discipline is necessary in governing students , but it should be done in a reasonable way . Abuse of disciplinary power should be limited and its execution w ay should be regulated in order to institutionalize and standardize the execution of disciplinary pow er .
