摘要
在中国延续半个世纪之久的劳教制度戛然而止,使得与劳教制度同生的劳教部门也面临诸多的现实困境。更好地对原劳教场所和工作人员进行角色与职能的转换,使人尽其能,物尽其用;对原劳教人群进行分流处理,使违法行为得到应有而适当的制裁,实现法的教育功能,这些问题都需要我们在实践中不断探索。对这些问题的适当处置,对节约行政成本、实现社会资源最大化利用以及社会的和谐发展都具有现实意义。
The detention system halted after the continuation of half a century in China, which made the detention departments living with the detention system also face many practical difficulties.Better convert the roles and functions of the former places and staff to make people do their best and places be best used;segregate the former inmates, so that violations are given due and appropriate sanctions to achieve the educational function of law, which are the problems we need to continually explore in practice.Proper disposal of these issues has practical significance to save administrative costs,maximize the use of social resources and harmoniously develop the society.
