重大建设项目决策中的公众参与障碍及对策论析——以近年来数起地方重大建设项目事件为例

近年来我国地方频发的重大建设项目事件折射出项目决策过程中公众参与环节的严重缺失与薄弱,其根源在于社会公众参与项目决策遭遇着重重困境与障碍,突出表现在参与主体的范围受限、参与时间和阶段的滞后、参与方式的流于形式、参与过程的信息公开不足、参与结果的反馈缺失等。迫切需要采取完善制度设计、规范信息公开、扩大参与主体范围、前置参与时间和阶段、开展实质性的多元参与方式、加强参与结果反馈等一系列措施保障和推进项目决策中的公众参与,以切实尊重和维护公众的参与权、知情权和表达权,促进重大建设项目决策合法性、民主性和科学性的整体提升。

In recent years, some local major construction project events happened frequently in China, which reflects the missing or poor public participation in the process of major construction project decisions. The root of the problem is that public participation in the process of project decisions faces many barriers and obstacles： for example, the range of public participant is limited; the time and stage of public participation is lagging behind; the ways of public participation are for- malized; the information disclosure of.public participation is not sufficient; the result feedback of public participation is missing, etc. Thus, in order to guarantee and promote public participation, respect and preserve the public~ fight to par- ticipate, know and express, improve the legitimacy, democratic and science entirely of major construction project deci- sions, we urgently need to take a series of measures, including improving system design, regulating information disclo- sure, extending the range of public participant, advancing the time and stage of public participation, carrying substantial ways of public participation, reinforcing the result feedback of public participation, etc.
