摘要
我国《物权法》规定了动产和不动产的用益物权,但只列举了一系列的不动产用益物权,并规定了部分用益物权的期限,对动产用益物权没有详细规定。有学者认为建设用地权的70年期限是除斥期间,进而推及到所有的用益物权期限是除斥期间。这一观点得到广泛的传播。然而,通过法理论证可知,现有用益物权的期限不是除斥期间,亦非取得时效或消灭时效,只是法定存续期间。
The Property Law of the People' s Republic of China regulates the beneficial property right of personal property and real estate, while it only lists a collection of beneficial property right of real estate as well as the duration of some usufructs, but there is no detail regulation on usufructs of personal property. Some scholars think that the 70-year period of construction land is a scheduled period. However, the legal principle proves that the duration of usufruct is not the scheduled period, acquisitive prescription or extinctive prescription, and it is just a legal duration of existence.
