社会公正的制度评价标准初探

评价社会公正有很多标准和尺度,但最根本的标准是制度,这符合马克思辩证唯物主义的基本观点。关键要看制度是否对全体社会主体具有统一的保障力和约束力,是否能保障最广大人民群众的根本利益。它体现在制度规定本身、制度执行过程及制度执行结果中,体现在对社会特需群体生活的保障上。这要求正确处理理论与实践的关系以及形式公正与实质公正的关系。

The evaluation of social justice covers a lot of standards and a large scale,but the system is the basic standards,basic ideas which conforms to the Marx dialectical materialism. The key is to see whether the system has a unified security force and binding on all the social main body and whether can safeguard the fundamental interests of the broadest masses. It is embodied in the system itself; system implementation process and the system implementation results are reflected in the social life of special groups of security. This requires the correct handling of the relationship between theory and practice and formal justice and substantive justice relationship.
