摘要药品试验数据资料专有权是TRIPS协议维护跨国制药企业利益的又一高标准知识产权保护制度,通过对各国试验数据专有权制度的国际考证,弹性解读TRIPS协议对药品试验数据资料专有权制度,严格限制资料专有权的保护范围、提升其法律位阶、制定仿制药申请的过渡条款,是制定符合我国国情的试验数据专有权制度的重要举措。
