分析了国内付款担保在建筑工程分包合同中的应用现状,针对付款担保在建筑施工分包合同应用中存在的问题,提出了完善付款担保法律体系、制定付款担保细则等解决措施,以保证付款担保能够在建筑施工合同应用中充分发挥作用。

The paper describes the application status of domestic payment guarantee in building engineering sub-contract. In light of its applica-tion problems, it puts forward some solving measures, such as improving payment guarantee law, and formulating payment guarantee regulations and so on, with a view to play the full role of payment guarantee in building construction contract application.
