摘要
随着国际跨国集团的快速发展,出现卖方作为承运人自己运输货物的现象越来越多。现有国际货物买卖的风险负担规则中,对该种情形下风险负担的规定尚存空白之处,司法实践中出现截然相反的判决。明确分析卖方作为第一承运人时风险转移问题,不仅是对国际贸易法律规范的完善,而且有利于国际经济贸易的顺利发展。要确定卖方作为承运人时风险承担问题,必须明确风险负担规则背后的理论基础,发现风险负担规则存在的瓶颈,才能对症下药。
With the rapid development of multinational conglomerates, the seller as a carrier transport goods themselves increasingly common. Exist- ing international sale of goods risk burden rules, the burden of risk species regulations surviving gaps under the circumstances, and judicial practice appeared opposite decision. Clear analysis of risk transfer issues as the first carrier when the seller is not only perfect the legal norms of international trade, but also conducive to the smooth development of international trade and economy. To determine the risk issues, seller as a carrier, the rules behind the theoretical risk burden must be clearly, the burden of risk discovery rules exist bottlenecks before remedy.
