科研院所职务发明奖励和报酬制度的若干思考

Study on Reward System for Service Inventors of Institutes and Universities

虽然专利法及其实施细则中的相关规定明确了对发明人或设计人的奖励和报酬制度,但科研院所作为事业单位,其专利属于国有资产保护的范畴,这些规定如何在科研院所具体实施,仍有很多实际问题。本文主要讨论了目前科研院所在制定并实施内部发明人奖励和报酬制度时的现状、遇到的实际问题,并对这些问题的解决方式进行一些讨论。

Patent law of the People＇s Republic of China and the detailed rules for the implementation of patent law establishes a reward system for service inventors. As for institutes and universities, situations are distinctive since their patents belong to the scope of state-owned assets. This paper discusses the current situations and existing problems of the reward system for service inventors inside institutes and universities, and tries to put forwards some countermeasures.
