关于尽快颁布我国海洋基本法必要性的探讨

The Discussion about the Necessity of Promulgating National Ocean Basic Law of China

以往就有学者、人大代表等呼吁制定《海洋基本法》,在越南颁布了侵犯我国海洋主权和管辖权的《海洋法》之后,制定我国《海洋基本法》的需要变得更加急迫。制定这一重要法律是我国海洋事业发展的需要;是处理海岸相邻、相向国家间关系,维护我国海洋权益,与周边国家共同治理和开发海洋的需要;是国家参与国际公共海洋事务处理的需要;是完善我国社会主义法律体系的需要;也是完善我国海洋法律体系的需要。

Many scholars and representatives of NPC in China have been calling for enacting＂The Basic Law of Ocean＂for a long time. The necessity of drawing up＂The Basic Law of Ocean＂became more and more urgent when Vietnam enacted their＂Law of Sea＂which violates China＇s ocean sovereignty and jurisdiction. Legislating the national ocean basic law is the need of the marine development in our country;the need to deal with the relationship with coastally adjacent and opposite countries and to maintain the national marine rights and interests; the need of joint governance and harmonious development of ocean resources with neighboring countries; the need to participate and cope with international public marine affairs; and the need to improve the Socialist legal system as well as ocean law system of our country.
