Pitfalls in Online Arbitration:An Institutional Explanation

摘要电子商务发展急需与之相适应的纠纷解决机制。在线仲裁是在线纠纷解决中最为主要的方式之一。在线仲裁如人们所预料的那样,一经建立便蓬勃发展,并迅速成为一种适应解决网络纠纷的在线纠纷解决方式。作为一种新兴的纠纷解决制度,在线仲裁在发展中较难克服的障碍是如何嵌入到线上线下社会的整体制度安排之中。因此,作为一项嵌入社会的纠纷解决制度,并从机制设计及机制实施的视角展开分析,能够为理解在线仲裁的困境提供有力解释。 It has been widely recognized that there is a need to address in a practical way disputes arising from e-commerce. Online arbitration is almost the most advanced form of online dispute resolution. Though a lot of effort was made to establish online arbitration as a tool for the resolution of e-commerce disputes, there are still many obstacles for it to substitute traditionalpitfalls in online arbitration.
