摘要
《中小学学生驱离学校处分正当程序法案》(PFDA法案)专门对停学、拒绝注册和开除三种驱离学校处分的正当程序作了说明,确立了非正式行政会议、书面通知、听证、申诉、司法审查、向其他机构通报、向上汇报和通知恢复入学这一系列法律程序。借鉴其有益经验将有助于增进我国中小学教育惩戒的合法性,也有益于提高惩戒教育程序的规范程度和可操作水平。
〈Pupil Fair Dismissal Act〉 in Minnesota is an act for the due process of law about suspension, exclusion, expulsion in elementary and secondary school. The due process of law is constituted by informal administrative conference, written notice, heating, appeal, judicial review, reports to service agency, reports to commissioner of educaiton, and notice of right to be reinstated. This act is beneficial for enhancing the validity and embodying the practice of educaion discipline＇s due process.
