论宪法对国家治理合法性基础的支撑方式

On the Supportive Mode Constitution to the Base of the Rationality of the Governing of the Country

在法治中国建设的整体背景下,国家治理的合法性基础是国家治理有效展开的前提条件。宪法作为国家的根本法、最高法和治国理政的总章程,既是对国家治理的总体性安排,同时也是支撑国家治理合法性基础的柱石。宪法对国家治理合法性基础的支撑见于宪法之首尾:宪法序言作为宪法文本的开端,主要是以历史叙事的方式,通过历史规律的建构,支撑了国家治理的合法性基础。宪法第四章作为宪法文本的结尾,主要是以符号叙事的方式,通过强化民众的国家认同以及国家对民众的精神感召、心理感召,支撑了国家治理的合法性基础。在法学理论中,见于宪法文本的首尾两个部分对于国家治理的合法性基础,起着不可替代的支撑作用。

In the background of Law and order in the sociaList construction,the rationaLity base of the governing of the country is the condition of the effective governing of the country. As the basic Law of the country and the supreme Law and the generaL charter of governing the country,it is not onLy the generaL arrangement of the gov-ernance,but aLso the coLLar of rationaL governing of the country. The supportive roLe of the governance is evi-denced at the beginning and the end of the constitution. The preambLe of the constitution uses the historicaL narration,together through the historicaL Law,to support the rationaL base of the governing of the country. As the end of the constitution,the fourth chapter uses symboLic narration to caLL on peopLeˊs spirituaL and psycho-LogicaL support. In Law theories,these two parts have pLayed irrepLaceabLe roLes in the governing of the country in a rationaL way.
