摘要
婚姻家庭本身具有建构性。改革开放以来,面对我国婚姻家庭生活的急剧变化,婚姻家庭制度的规范力和塑造力弱化,制度变革体现为对生活实践变化的被动接受,继而加剧了婚姻解体的趋势。当下极有必要反思婚姻家庭制度与生活实践的相关性问题,这涉及婚姻家庭理想模式建构、制度规范重构以及婚姻家庭纠纷审理的司法程序设计等内容。
Marriage and family itself is constructive. Since the reform and opening up,in the face of dramatic changes in marriage and family life in China,norms force and shaping force in marriage and family system weakened,institutional change reflects passive acceptance in changes of practice life,which in turn exacerbated the trend of dissolution of marriage. It is extremely necessary to reflect the relevance issue between life practice and marriage and family system,which involves the construction of an ideal model of marriage and family,reconstruction of rules and norms,as well as judicial procedure design for trial of marriage and family disputes and other aspects.
