摘要
福建省南平市松溪县的村民约"法"是对"村规民约"的丰富和完善,具有地域性、权威性和灵活性等特征。在村民约"法"的实施过程中,存在传统与创新、任意与规则、德治与法治冲突等问题,需要站在法治的视角,采取合乎现代法治精神的措施,实现村民约"法"与国家法的良性互动,发展和完善村民约"法"的乡村治理模式。
In Songxi County of Nanping City in Fujian Province, civilian laws are developed to enrich and perfect the village regula- tions and non-governmental agreements with the characteristics of locality, authority and flexibility. In the implementation of civilian laws, there are conflicts between tradition and innovation, between arbitrariness and regulations, and between rule of virtue and rule of law, so the measures according to the spirit of modem rule of law are demanded to bring about the favorable interaction between civilian laws and state laws and improve the rural governance mode of civilian laws.
