论我国《种子法》的修改与完善——以品种审定制度为视角

On Amendment and Improvement of the PRC Seed Law:From the Perspective of Variety Certification System

我国《种子法》修改工作已经启动,品种审定制度是此次修改中学界最为关心的热点问题。由于立法固有的滞后性,随着近年来种子产业的快速发展,《种子法》及配套规章关于品种审定制度的一些问题逐步显现出来。笔者通过对品种审定制度相关法律条文进行行政法实践与理论分析认为,品种审定制度应当逐步过渡到品种登记制度。改革品种审定制度应当抓住修改法律的有利时机,在《种子法》中进行新的制度设计:在结构体例上另设专章规定品种登记,在内容规范上明确品种登记的核心制度与配套措施。

The ＂seed law＂ revision work has already started, variety certification system is the most concerned topic. Legislation lag today＇ s reality. With the rapid development of seed industry in recent years, the problems of the ＂seed law＂ and supporting regulations on variety certification system gradually revealed. By analyzing the relevant legal provisions of variety certification system, the author thinks that variety certification system should be a gradual transition to the variety registration system. The reform of variety certification system should seize the favorable opportunity of law revision. The new system design of the ＂seed law＂ is that a special chapter should stipulate variety registration in the legislative style and constitute the core system and supporting measures.
