Large sample analysis on litigation medical malpractice in Beijing in 2013

北京市法院2013年一审受理的医疗纠纷案件为1152件,一审审结的医疗纠纷案件共1044件。通过对案件的分析,发现当前北京市医疗纠纷呈快速增长趋势,三级医院和二级医院更容易发生医疗纠纷。医疗纠纷高发科室相对恒定,妇产科、骨科、普外科、急诊科均为医疗纠纷高发科室。在医疗纠纷诉讼案件中,患方获赔几率为71.21%,医疗纠纷约46%进行医疗责任鉴定。

The Courts of Beijing Municipality have accepted and heard 1,152 malpractice disputes in 2013, 1,044 （including 896 medical damage liability disputes and 148 medical services contract disputes） of which have been concluded at the first instance.” Now, the medical treatment disputes of Beijing Municipality show a rapid growth trend, and the tertiary and secondary hospitals are prone to see more medical treatment disputes. Departments of relatively high malpractice occurrence rate are constant and such departments are prone to see malpractice as obstetrics and gynecology, orthopedics, general surgery, and emergency department. Out of the described malpractices, the possibility that the patient is compensated is 71% and medical liability identification is conducted for approximately 46% of the malpractices.
