摘要
1999年《蒙特利尔公约》为国际航空运输中承运人责任的确定提供了统一的实体法规则。公约确定了5种管辖权,如何在其中做出选择不仅关系着诉讼能否顺利展开,也可能对最终的诉讼结果具有重要的影响。结合韩亚航空事故的具体情况,对旅客一方可援引的5种《蒙特利尔公约》管辖权进行逐一分析,指出死伤的中国旅客将很难依据公约在美国提起诉讼。
The Montreal Convention of 1999 ( MC) provides a set of uniform legal rules for carrier's liability in inter-national air carriage .MC also stipulates five kinds of jurisdiction choice for plaintiffs and the determination of juris-diction is one of most important factors in litigation since it always has influence on the litigation result .From the per-spective of Asiana victims , a comparative analysis is made on jurisdiction rules of MC, and the conclusion is that there is little possibility for Chinese passengers to sue Asiana Airlines in the territory of US .
