校外人员进校参加体育锻炼意外伤害的归责分析

我国用于群众体育的体育场馆设施严重不足,所以国家提倡鼓励机关、学校等单位内部的文化体育设施面向公众开放。在这样的背景下,在学校的体育教学训练之余,大量的校外人员会涌进学校,利用学校的体育场馆设施参加体育锻炼,而体育运动是有风险的,发生意外伤害在所难免。本文分析了校外人员进校参加体育锻炼意外伤害的一些理论问题,得出自己的结论,即学校同样有义务为校外人员进校参加体育锻炼提供安全的体育场馆设施,并且如果因不安全的体育场馆设施引起的伤害,将不适用自承风险理论。

For mass sports in China is serious shortage of sports facilities , so the state encourages institutions , schools and other units within the cultural and sports facilities open to the public .In this context , in the school sports teaching training , a large number of outside school personnel will pour into the school , use the school sports facilities take part in physical exercise , and sport is risky , accident damage is inevitable .This paper analyzes the external personnel to school take part in physical exercise injury of some theoretical problems , their own conclusions , the school also have an obligation to school for school personnel to participate in physical exercise to provide a safe sports facilities , and if the damage caused by unsafe sports facilities , and will not apply the risk theory .
