心理性罪过概念自身存在着严重缺陷。德国学者对它说"不",用规范性罪责概念取而代之。俄罗斯刑法理论中的罪过概念是不纯正的心理性罪过概念。我国的罪过概念面临着挑战,引进规范要素(评价要素)是对挑战的合理回应。

There are gross defects in the psychological concept of crime. German scholars said ＂ No＂ to it,and replaced it with the normative concept of crime. The definition of crime in Russian criminal theory is not a pure psychological concept of crime. Nowadays,the concept of crime in China is facing with a great challenge. Besides,recommending the normative elements（ assessment elements） is a reasonable respond to the challenge.
