涉台婚姻妇女面临的困境与法制

Plight and Legal System Faced by Women Involved in Taiwan-related Marriage

大陆地区与台湾地区自上世纪80年代起,各项交流频繁,接触日多,进而有两岸人民的通婚现象,其类型可划分为老夫少妻型、假结婚型及生儿育女型,但诸多基于功利婚,双方感情基础薄弱,因社会阶层较低、经济状况不佳等等事实面因素,致婚后多有伴随家庭暴力,乃至离婚等问题。台湾地区移民政策尚缺整体规范法制,表现于婚姻移民之上,有其不足,并助成涉台婚姻者的困境。本文以此为探讨对象,分析婚姻类型,研究困境发生原因,并指出法规不公平对待及歧视大陆新娘之所在,最后提出建言,以期朝正面发展。

Since the 1980s, China's Mainland and Taiwan have had frequent exchanges and contact in many fields, thus creating the phenomenon of intermarriage between people on both sides, with the types falling to the following categories：＂May-December Marriage＂,＂sham marriage＂and＂marriage for bearing children purpose＂. As a result of utilitarian marriage, those couples have weak sentimental connection;compounded with factors such as lower social class and poor economic conditions, domestic violence, divorce and other issues will ensue. Taiwan immigration policy still lack a complete framework and leads to the plight of those involved in Taiwan-related marriage. Based on these issues, marriage types, cause of the plight are examined, meanwhile, the cause of the unfair regulations and discrimination against mainland brides are pointed out.
