这是一起经典的海事判例。在能见度良好条件下两船在航道中行驶,一船犯有在中央航道左侧行驶的错误;另一船在和来船对驶相遇时犯有操左满舵,未采取有效的避碰手段和未鸣放声号等错误。两船碰撞、一船沉没。法庭判决:两船对碰撞各承担50%的责任。
This is a classical marine judicial precedent.Two ships were operatingunder good visibility.One ship has the mistake to operate in the left of thecentral channel;the other has the mistakes of using full portboard whenmeet the ship sailing in an opposite way.At the time,no effective avoidingmesure was taken and no audio signal was given.Therefore,the two shipsran into each other.And one of them sank.The court gives the followingjudgement.Each ship should bear 50% responsibility because the two shipscame into collision on head.
