法律移植的终极目标就是把移植的法律本国化,使其成为本国法律体系中的一部分,并为本国法律体系带来生机和活力。然而,实现这一目标,确有很大难度。每个国家的国情不同,导致了移植的手段、内容和方法的不同。所以,在法律移植这一领域没有什么规律可循。适合别国的,未必适合本国,只有根据自己的国情,理性移植,谨慎对待。经验表明,盲目行事必定失败。所以理清我国法律移植存在的困惑,是法律移植能否成功的关键之所在。

The ultimate goal of legal transplantation is to nationalize the transplanted law, to make it a part of the national legal system, and to bring the vitality and the vigor for the national legal system. However, it is really difficult to achieve this goal. Each country is different in national conditions, resulting in the difference in transplantation method, content and methods. So, in the field of legal transplantation, there are no rules to follow. Something suitable for other countries may not be suitable for our own country, so it should transplant reasonably and cautiously treat only according to own national situations. Experience shows that, act blindly will be bound to fail. So to clarify the confusion in China＇s legal transplantation is the key to whether the legal transplant will succeed or not.
