摘要
近代监禁刑的产生,取代了古代残酷的死刑、肉刑,这不能不说是人类文明的一大进步;围绕着监禁刑发展起来的一系列监禁制度已走过较长的历史时期,其与现代社会发展下社会理念的冲突也愈发明显。可以说,现代监禁制度在理性与进步的价值追求目标下,实现自身变革已刻不容缓,这也是现代刑罚理念和刑罚目的的客观要求。
The replacement of ancient cruel death and corporal punishment with modern imprisonment has been a great progress of human civilization, and the prison system, concerning the punishment of imprisonment, has gone through a long history. How- ever, its conflict with modern social concepts is becoming more and more apparent with the development of society. Hence, it is urgent to reform modern prison system , which is in pursuit of the values of reason and progress. This is also the objective requirement of modern penal philosophy and purpose of punishment.
