我国食品安全问题频发是市场化改革条件下政府监管不到位、企业行为扭曲、社会中介机构缺失共同作用的结果。究其原因,是改革转型过程中食品质量安全的控制权被留置在公共域,相关权利界定不清所致。对食品质量安全的有效监管,需要明确界定食品质量安全的控制权,将其在不同利益主体之间进行合理配置,分清不同主体的责任和义务,形成对食品质量监管的激励和约束机制。文章通过对食品安全问题产生的制度背景的分析析,结结合市场化和企业改革现状现状,从从企业控制权、政府监管模式的变迁与食品质量之间关系的角度,探讨加强食品质量安全有效监管的路径。

Under the condition of market reform in China, the frequent occurrence of food safety issues is the common effect of the lack of government regulation, distorted enterprise behavior, and the lack of social intermediary organizations. The reason is that the control right of food quality was detained in the public domain and ill - defined during the process of transformation. In order to reform the food quality supervision, the control right on food quality needs to be defined clearly, and allocated in different subjects with clear responsibility and duty, In this case the effective incentive and restraint mechanisms can be formed. According to the present situation of marketization and the reform of enterprises, in terms of rights of enterprise, mode transfornlalion of government supervision and ft^od quality relations, this article proposes the effective method how to enhance food quality and safety supervision by analyzing system background of the food safety issues.
