摘要
国际工程是一项涉及面广、不可预测因素多的系统工程,广泛涉及法律、合同、索赔和保险等法律事务,高素质法务管理团队成为国际石油工程公司最宝贵的资源和竞争优势的来源。由于认识上的偏差以及历史、制度等方面的原因,我国石油工程公司的国际法务队伍建设相对迟缓,具有法律知识的复合型人才匮乏,已经成为公司持续发展的瓶颈。基于我国某石油工程公司,剖析我国国际工程公司法务队伍建设存在的问题和原因,并提出了构建法务队伍成长机制的思路:1)尽快搭建和发展国际水准的公司法律资源体制,培养具有国际水准的公司法务人员;2)以国资委提出的第三个"三年目标"为契机,完善和强化企业法律风险防范机制、总企业法律顾问制度和法律管理工作体系,加快提高法律顾问队伍素质和依法治企水平;3)努力营造与法律环境相适应的企业法律文化氛围;4)加快法务专家的培养,增强自身造血功能。
International engineering involves a wide range of aspects, systems with many unpredictable factors, and extensively involves law, contracts, claims, insurance, etc. A high quality legal team becomes an international petroleum engineering company's most precious resource and a competitive advantage. Competition in the international contracting market in the final analysis is talent competition. In the past 30 years in the international engineering industry, contractors in China have trained a large amount of international engineering and management talent. But, because of cognitive biases, history, and institutional and other aspects, building international legal teams at Chinese petroleum engineering companies has been a relatively slow process, with a scarcity of talent possessing complex legal knowledge and this becomes a bottleneck in a company's continued development. On the basis of a representative Chinese petroleum engineering company, problems and their reasons in building a legal team at Chinese international petroleum engineering companies are analyzed, and ideas for a mechanism to develop legal team building are proposed: 1) building and developing the company's legal resources system as soon as possible to international standard, and building to international standard a corporate legal team; 2) using the third 'three year goal' promoted by the State-owned Assets Supervision and Administration Commission as an opportunity to improve and strengthen the legal risk prevention mechanism and the overall enterprise legal counselling system and legal management system to accelerate improvement in the quality of the legal team and the level of legal management of the enterprise; 3) making efforts to create, and a legal environment to assist adapting to, a corporate legal culture atmosphere; 4) accelerated training of legal experts to boost the generation of new blood.
