“栽岩”的社会功能及其民族法文化特征

The Social Function of "jenl vib" and its Characteristics of Ethnic Customary Law

"栽岩"是比较原始的一种习惯法形式。这种民族法文化特征在黔湘桂交界的侗族、苗族、壮族、瑶族、水族社会中形成了过去盛行并延续到今的"栽岩文化圈"。从功能上分类,需要"栽岩"的情形大概有:划界类栽岩、裁判类栽岩、改革类栽岩、防御类栽岩。

＂jenl vib＂ （language of Miao nationality）, is a primitive form of customary law. This law cultural phenomenon formed a ＂cultural circle of jenl vib＂ , which was prevalent in the past and still remains alive today among the nationalities of Dong, Miao, Zhuang, Yao and Shui living in the junction of Guizhou, Hunan and Guangxi. ＂jenl vib＂ can be functionally classified into the circumstances of demarcation, adjudication, reform and defense.
