On the Direction of China's Legal Logic from the Perspective of its Development Course

从20世纪80年代初至今,我国法律逻辑经历了应用逻辑阶段和以非形式逻辑为主导的多元发展阶段。这一发展历程表明,法律逻辑的发展一方面受制于逻辑学、法学等与其直接相关的基础学科,另一方面又以我国法律实践的现实需求为依归。在逻辑发展多元化以及司法中心化的当代,我国法律逻辑的发展仍将以非形式逻辑为主导。

Since the early 1980s, the study of legal logic in China has experienced the stage of application logic and a multiple stage dominated by informal logic. This course shows that, the development of legal logic is subject to the basic disciplines such as logic, law, ere, and needs to satisfy the realistic needs in China＇s legal practice. Facing today＇ s diversified development of logic and justice-centrie situation, the direction of China＇s legal logic will still be dominated by informal logic.
