城乡居民最低生活保障制度的公平研究——以2004～2014年的数据资料为依据

On Fairness about the System of the Minimum Living Security of Urban and Rural Residents——Based on Ten Years Data from 2004 to 2014

公平的城乡居民最低生活保障制度是实现人权的基本需要,也是是社会公平的基本内容。制度化的城乡二元对立是造成实践中城乡居民最低生活保障不公的制度原因。所以,要从根本上解决城乡居民最低生活保障的不公必须从公平制度入手。文章力图在平等性和差别性相结合的公平原则指导下,从确立公平合理的低保标准、构建公平理性的法律和经济制度等方面提出了构建公平正义的城乡居民最低生活保障制度的设想。

Fair minimum living security system of urban and rural residents is the basic demand to realize human rights and the content of social equity and justice. The institutionalized differences between urban and rural are the system reasons which cause the unfairness in the minimum living security of urban and rural residents in practice. So we must start from the fair system in order to fundamentally solve the unfair in the minimum living security of urban and rural residents. By establishing fair and reasonable minimum standards and economic and legal system under the principle of fairness formed by equality and difference, the article puts forward fair and justice minimum living security system of urban and rural residents.
