城市古建筑保护法律问题研究——以北京旧城为样本

Study on legal Protection mechanism of ancient building in Chinese urbanization district——taking the old Beijing city as a sample

城市是人类生产和生活的中心,城市的历史发展为我们遗留了大量的城市古建筑等文化遗产。我国正处于城镇化的关键节点时期,如何既实现城市又快又好的发展,又保护好这些历史遗留的珍贵历史文化遗产,成为我国城市化过程中的重大课题。文章针对北京城市古建筑保护制度中的现存问题,通过梳理建国后北京古建筑保护的历史和实践经验,并借鉴英国《登录建筑及保护区规划法1990》等域外制度,提出建立适合中国城市发展转型期的城市古建筑保护法律制度的建议,破解发展中的二元难题。

City is the production and living center of human being, with its long history, the city has left us a lot of ancient architecture and urban cultural heritage. China is now at the critical joint of urbanization, it has become a major research project how to achieve the urbanization smoothly on one hand, and how to protect the precious historical and cultural herit- age effectively on the other hand. By presenting the problem in the daily life, the article looks for the solution from the ex- periences of China and other countries, then give some suggestion to resolve this problem.
