指出了我国现行公司资本制度已由注册资本制过渡至授权资本制,在现行资本制度下,如何对债权人的利益进行保护是值得思考的问题。通过对我国资本制度改革的评析和现行资本制度下对债权人利益保护的探讨,分析了现行资本制度改革对债权人利益保护影响的原因和现行资本制度改革下债权人利益保护制度的缺陷,提出了我国现行资本制度下对债权人利益保护的完善措施。

In China ,the current capital system of company has been transferred from registered capital system to the authorized capital system .Under the current capital system ,how to protect the creditor＇s interests has been an issue that worth considering . Through evaluation of the reform of capital system and discussion of the protection of creditor＇s interests under the current system ,the article analyzes the causes that the reform of capital system affects the protection of creditor＇s interests and the defects of protection system of creditor＇s interests under the current capital＆amp;nbsp;system .In the end ,the article puts forward perfection measures to protect the creditor＇s interests under the current capital system in China .
