法治进行时中孔子法律思想的“现代性阐释”

“Modern Interpretation” of Confucius' Legal Thought in the Progressive Tense of Law

法治永远是个历史的概念,每一个时代的法治都只是"进行时",而非"完成时"。当今与孔子时代相隔两千多年,孔子时代并没有产生现代法治的物质生活基础,孔子的法律思想与现代法治没有必然的关系,既不必然阻碍现代法治,也不必然导致现代法治。孔子的法律思想和同时代西方思想家相比毫不逊色,对现代法治仍有借鉴作用。

The rule of law is forever a historic conception,and legal rule in every era is only the＂progressive tense＂inside of ＂perfect tense＂.Over two thousand years from Confucius era,there was no the material life basis for producing modern rule of law.So there was no necessary relation between Confucius＇ legal thought and modern rule of law,neither hindering nor causing modern rule of law.Confucius＇ legal thought was not inferior to modern west thinkers,and still has significance for modern rule of law.
