法官资源“剪刀差”问题研究

Research on Scissors Difference of Judge Resources

法官资源作为一种司法公共资源,在城乡法院之间、不同层级法院之间、不同区域法院之间的公平配置和有效利用不仅关乎公正、效率等司法目标的实现,而且也影响到国家司法的统一性和社会的公平正义。然而,我国法官资源的配置却呈现一定程度的城乡"剪刀差"、层级"剪刀差"和地区"剪刀差"的样态,这不仅难以突显国家司法的统一性,而且也不利于维护社会公平正义,同时还背离了程序正义的司法原理。为此,有必要健全法官资源配置制度,逐步缩小直至消除法官资源"剪刀差",以体现国家司法统一,维护社会整体正义,彰显司法公正高效。

As public resources,equitable distribution and effective utilization of judge resources between different courtfrom different areas and class and in urban and rural areas affect not just about achievement of fair and efficiency but unity of state law and social justice. And yet this phenomenon comes to happen to some extent in our country. It is not only difficult to highlight unity of state law,but also against safeguarding social fair justice,and deviate from the judicial principle. So,it is necessary to improve distribution system of judge resources,and gradually to eliminate scissors difference and fulfill its object efficiently.
