摘要
由于非强制行政这种带有柔性色彩的执法方式建立了官民之间的合意基础、有助于维护社会和谐、保障公民尊严,因此更有助于推进服务行政理念的实现。各地方陆续开展的非强制行政实践尽管已经取得了卓越成效,但部分案例亦反映出一些问题,比如非强制行政有时会不当取代强制行政、选择行政奖励方式时存在着两难困境、行政调解中有时权力因素过强,以及行政合同中当事人双方不够对等。因此,时刻对其进行关注,并通过制度规范的形式加以解决,即是增强政府柔性执法实践合理性的必要步骤。
Because the flexible enforcement way of the non--mandatory administration lays a foundation for the consensus between the government and the people, which helps to maintain social harmony and guarantee the dignity of citizens, it helps to promote the realization of Service Administration. Although the non--mandatory administrative practices enforced by various local governments have achieved remarkable successes, some cases also reflect the problems. For example, non--mandatory administration sometimes can replace mandatory administration inappropriately; there is always a dilemma during the selection process of administrative rewarding approaches; the power factor is sometimes too strong during the administrative mediation; as for the administrative contract, the two sides are not equal. Thus, it is an essential step to enhance the rationality of flexible enforcement practice of the government by constantly concerning about and through the form of rules and norms.
