摘要
由于现行《著作权法》法定许可制度中付酬机制的缺失导致著作权人实际上仍很难取得报酬,本次对《著作权法》进行修改时注重了对付酬制度的完善。目前的《著作权法》修改草案第三稿建立了首次使用备案制等制度,有利于减少法定许可不付酬行为的发生。文章在对《著作权法》修改草案的规定进行分析之后,提出了制定具体的付酬实施细则以及改变著作权集体管理组织管理现状的建议,以达到法定许可使用制度与法定许可使用费制度平衡的目的。
Since there is no payment mechanism with legal license in the current Copyright Law, the draft amendment to the Copyright Law emphasizes on the improvement of the remuneration system to protect the copyright holder to get paid. The third draft of the revised Copyright Law for the first time established a filing system and other systems to help to reduce the delict. With an analysis of the provisions of the draft amendment to the Copyright Law, this paper proposed to develop specific implementation rules and change the situation of copyright collective management organizations to achieve a balance of the legal license use mechanisms and the payment mechanisms with legal license.
