党的十八届四中全会决定要求建立宪法宣誓制度,宪法宣誓制度作为世界普遍确认的宪政制度,具有丰富的域外经验和中国实践。宪法宣誓制度的中国构建的理论基础在于宪法授权理论和人民主权理论,实践基础在于尊重宪法的需要和坚持依宪治国。宪法宣誓制度兼具仪式化和法律化双重功能。当务之急是要精心设计、规范构建出中国特色的宪法宣誓制度。

The decision of The Fourth Plenary Session of the 18th CPC Central Committee requested the establishment of constitutional oath system,and every eye for hope,have very high expectation.The constitutional oath system as the world generally confirmed the constitutional system,has the rich extraterritorial experience and Chinese practice.Theoretical founda-tion of China＆#39;s construction of constitutional oath system lies in the constitution authorized theory and people＆#39;s sovereignty theo-ry.The practice base is the need to respect the constitution and the need of Anti-constitutionalism countercurrent to bring or-der out of chaos.The constitutional oath system with double functions on ceremonial and legalization.It is imperative to care-fully design and specification to construct Chinese characteristics constitutional oath system.
