对我国票据丧失之法律救济制度的思考

Consideration of the Legal Relief System for Bills Loss

票据作为完全有价证券,一旦丧失,持票人便无法行使其票据权利。虽然我国现行法律中对于票据丧失后的法律救济给予了较为完整的规定,但是实践证明目前已有的法律救济制度仍不够完善。为此,在对该制度的基本内容给予详细阐述的基础上,对其在具体适用中所存在一些问题进行了深入思考,并在此基础上提出了自己的建议,以期对我国票据丧失之法律救济制度的建设略尽微薄之力。

Bills as a full portfolio,once get lost,the holder will not be able to exercise their bill rights. Although China＇s current laws regarding legal relief after bill losing are complete,it has proved that the current legal relief system is still not perfect. correspondingly,the paper,based on the profound elaboration of the relevant laws,probes some problems in their application,and then puts forward some suggestions to perfect the relief laws and regulations.
