摘要
从法律和信任两个维度,运用比较经济学的分析方法对我国当前居民小区物业管理纠纷频发的原因进行研究后不难发现,在物业管理中大量地存在政府行为被市场行为的不当替代,以及政府行政管理退出后,相关配套法律制度供给呈现严重不足的情形;而当代中国社会所普遍存在的信任危机,使得业主和物业管理公司难以摆脱"维权难"、"治理难"的双重困境;同时,由于市民资本运作意识缺位,进一步加剧了物业管理中信任危机的频度和力度,进而阻碍有效的沟通与合作。要建立顺畅的物业管理秩序就必须尽快改善法律的制度供给,重建各方信任关系。
Analyzing the reasons of property management disputes frequently happened in current China by employing comparative economics approach from the dimension of law and trust, it is not hard to find out that government's role has been replaced by market force improperly and that relevant legislations are in serious short supply with the withdrawal of administrative force from government side. Additionally, the prevalent crisis of trust in current China makes it difficult for both property owners and property management companies escape from the double dilemma of maintaining lawful rights and ensuring proper governance. In the meantime, due to the lack of financial awareness of common citizens, the frequency and intensity of the trust crisis in property management have been accelerated, thus greatly hindering the effective communication and cooperation of both sides. Improvement in legislation supply and reconstruction of mutual trust are n6eded for the establishment of smooth property management order
