摘要
香港基本法实施以来,特区法院在有关案件中多次重申"普通法传统",借以阐明基本法的含义、推动相关法律原则与规则的发展。在"一国两制"的背景下,香港的普通法传统既有助于延续香港长久以来的法治传统,也有助于因应社会变迁,促进基本法法理不断趋于完善。普通法作为香港原有法律制度最重要的组成部分之一,对基本法的顺利实施至关重要。同时,基本法作为香港特区宪制性法律,也会给香港的普通法传统注入新的内涵。
Since the Hong Kong Basic Laws taking into effect in 1997, the courts of the Region have reiterated the "com- mon law tradition" many times in cases to facilitate the interpretation of the Basic Law provisions and the development of relat- ed legal doctrines and principles. In the context of the "one country two systems" policy, the common law tradition in Hong Kong is beneficial to both the preservation of the rule of law in the Region and facing the challenge of changing society by enric- hing the jurisprudence of the Basic Law. On one hand, the common law, as the vital part of the original legal system in Hong Kong, is indispensible to the implementation of the Basic Law; while on the other hand, the Basic Law, as the constitutional instrument of the Region, is bringing new norms into the existing common law in Hong Kong.
