摘要
专家责任中的专家对第三人责任是侵权责任法中一个重要的方面,而我国现行的《侵权责任法》中并未对其作出明确的规定。在比较法上,专家对第三人责任的规范模式有合同责任和侵权责任两种。我国应采侵权责任模式,在此模式下,我国《侵权责任法》对专家对第三人责任应予细化规定。
Third party liability of experts ofProfessionalLiability is one of the important aspects in the tort law,but our legislation did notmake the rules.On theComparativeLaw,the regulations about this are contract liability and tort liability.As for our legislation,we should regulateby tort liability and our tort lawshouldmake the rules on details.
