我国“准入前国民待遇”制度研究——以上海自贸区为视角

上海自由贸易实验区的成立有一个重要突破,即推行准入前国民待遇制度。但上海自贸区"准入前国民待遇"制度还存在一定问题。应当从明晰概念、完善"负面清单"、提供公平开放的外部环境、借鉴双边或区域投资协定的做法等方面进一步完善。

Shanghai Pilot Free Trade Zone has an important breaking.It imposes the system of the pre-estab- lishment national system of China （S treatment system. This article discusses the concept of the pr-establishment national treatment hanghai） Pilot Free Trade Zone and the problems in it. Facing these problems, the writer proposes the following ways to solve these problems ： give a clear definition of the system, improving the regulation of the negative list, providing the fair and open environment outside, using the regulation of the bilateral or multilateral investment treaty for reference.
