重塑司法解释体制、助力法治中国建设——完善现行司法解释体制的几点思考

经过新中国成立以来60多年的不断探索,我国目前已经初步形成了"二元一级"的司法解释体制,这一体制的形成和完善对于建立健全中国特色社会主义法律体系、推动社会主义法治国家建设无疑起到了不可估量的作用。完善现行司法解释体制,应当逐步规范现行司法解释体制,强化立法解释,有条件的引入判例制并建立健全司法解释监督机制。

Today China has formed ＂dual level＂ judicial interpretation system, the formation of the system has perfected the legal system of our country, promoted the construction of a socialist country under the rule of law. Improving the current judicial interpretation system, shall standardize the current judicial interpretation system, strengthen the legislative interpretation, the introduction of conditional test system and perfecting the judicial interpretation supervision mechanism.
