摘要
消费者后悔权是《消费者权益保护法》为平衡市场交易关系中因经营者强势地位而导致的消费者合法权益得不到有效保障而设立的倾斜保护制度。在实践中,消费者可能基于自身利益考虑而滥用后悔权,容易导致消费者道德风险问题,从而影响正常的市场交易秩序。要平衡消费者和经营者之间的利益关系,防止消费者滥用后悔权,就需要对消费者后悔权道德风险进行防范化解。
Consumer Regret Right, an inclinable protection policy, is established by Consumer Protection Act to avoid such phenomenon that consumer's legitimate rights and interests cannot get effective guarantee due to the business operator' s strong position, and to balance the market trading relationships. In practice, based on their own intex^ts, consumers may abuse the regret right, which can easily lead to moral hazard problem, and thus affect the normal market trading order. Therefore, it' s a great need to prevent and defuse the moral hazard of consumer regret right so as to prevent consumers' abuse of regret right and to balance the interests relationship between the consumer and the business operator.
