On the Implementation of Administrative Coercion in Administrative Punishments

行政处罚实施过程中,行政强制与行政处罚有密切的关联,行政强制措施和行政强制执行方式广泛应用于行政处罚立案、调查、执行等环节,对行政机关办理行政处罚案件发挥积极作用。行政机关实施这些行政强制应当遵守法定权限并符合法定程序,在行政处罚程序启动前、实施过程中、处罚决定作出后,及时、正确地采取行政强制措施和行政强制执行,有效保障行政处罚的顺利进行。

Administrative coercion has tight relationship with administrative punishment in implementation of administrative penalties.Administrative coercive measures and administrative enforcement are widely used in the process of administrative punishments such as filing a case,investigation and execution.They play an active role for administrative organs in handling administrative penalty cases.Administrative organs should implement administrative coercion within statutory limits and in accordance with legal procedure,including using administrative coercive measures and administrative enforcement timely and correctly to ensuring enforcement of the administrative punishments before the start of filing a case,during investigation and after the decision on administrative punishment.
