非理性社会舆论下司法正义的实现——由“夏俊峰案”引发的思考

The Realization of Judicial Justice under Irrational Public Opinion——Thinking Triggered by "Xia Junfeng's Case"

"夏俊峰案"引发了大规模的非理性社会舆论。这既是传统法律制度与现代法治观念冲突所致,也与当前民众日益增强的维权意识和脆弱的司法权威有密切关系。非理性舆论作为社会舆论的一种,是公民言论自由的表达,在某种程度上能促使司法机关更加审慎的对待案件,保障司法公正;但亦存在着干扰司法独立、侵蚀司法权威等诸多消极影响。恪守司法独立理性审判、扩大审判的公开性保障民众知情权、加强判决的说理性以理服人、加强司法机关自身的建设是在非理性社会舆论环境下实现司法正义的必要措施。

＂ Xia Junfeng＇s case＂ triggered a massive irrationality of public opinion.This is not only caused by the conflict between the traditional legal system and the modern concept of law,but also by the conflict between people＇s growing awareness of rights and fragile judicial authority.To a large extent,the impact of irrational public opinion is negative.To stick to the independence of the judicature,to safeguard people＇s right and to strengthen the reasoning of judgment,and the construction of judicial organization are indispensable way to realize judicial justice in the irrational public opinion environment.
