中国政治宪法学是中国宪法学的一个理论流派,它的特点是从政治的角度出发研究宪法。中国政治宪法学的提出表面上看是因为宪法规范有效性不足,背后实质隐藏着某种"事实"与"价值"之争。在中国政治宪法学理论的建构中,国外的"宪法政治"与"政治法学"两大理论已经成为其主要依托的理论资源。因此,对中国政治宪法学进行理论上的溯源,不仅能加深我们对中国政治宪法学的理解,也使我们认识到它所具有的价值。

Chinese political constitutional jurisprudence is a theoretical school of Chinese constitutional jurispru- dence, and its characteristic is to study the constitution from the political perspective. On the surface, Chinese po- litical constitutional jurisprudence has been advanced just because of the insufficient validity of constitution norms, but the hidden essence is some struggle between the ＂fact＂ and ＂value＂. During the construction of the theory of the Chinese political constitutional jurisprudence, the foreign theories named ＂constitutional politics＂ and ＂politi- cal jurisprudence＂ have become the main theoretical resources to rely on. Therefore, tracing back to the theoretical source of the Chinese political constitutional jurisprudence, can not only deepen our understanding on it, but also make us realize its value.
