Rule and Exception——The Optimization Program of Old-building Renovation under the perspective of Law

由于缺乏相适应的标准和程序,老旧楼宇的改造项目仍沿用新建建筑的审批程序,致使项目审批受阻,本文从法律视野着眼,阐述了老旧楼宇改造的法律属性和法律"规则—例外"的特性,并以此为基础提出老旧楼宇改造审批程序的优化措施。

Due to the lack of suitable standards and procedures, renovation project of old-buildings is stil fol owing the procedures of new constructions for examination and approval, which making the approval hindered. From the legal perspective,This paper expounds the legal at ribute of old-building renovation and ＂rules and exceptions＂of law, and put forward measures to optimize the procedures for old-building renovation approval.
